1. Acceptance of Terms
These Terms and Conditions (the "Terms") constitute a legally binding agreement between you and TailsTrails Social Inc., a company incorporated federally in Canada with provincial registration in British Columbia ("TailsTrails™," "we," "us," or "our").
By creating an account, accessing, or using the TailsTrails website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms, our Privacy Policy (available at tailstrails.app/privacy), and our Community Guidelines. If you do not agree to these Terms, you may not use the Service.
These Terms apply to both the TailsTrails waitlist website (currently live) and the TailsTrails mobile application (upon launch). Certain features described in these Terms may not yet be available and are indicated with "when available" or similar language. When those features launch, they will be governed by these Terms without requiring a separate agreement.
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and TailsTrails regarding your use of the Service, and supersede all prior agreements, understandings, and communications.
2. Eligibility
To use TailsTrails, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement in your jurisdiction
- Not have been previously banned or removed from TailsTrails
- Not have been convicted of a violent crime, sex-related offense, or any crime involving animals, and not be required to register as a sex offender in any jurisdiction
By creating an account, you represent and warrant that you meet all of these eligibility requirements.
TailsTrails reserves the right to request verification of age or identity at any time and to terminate accounts that do not meet these eligibility requirements.
3. Account Registration and the Dog-First Architecture
3.1 How TailsTrails Works
TailsTrails uses a dog-first profile architecture. Your dog's profile is the primary, public-facing entity on the platform — it carries the @handle, photo, personality traits, and content. Your human profile is the account and authentication layer behind it, and will show on the mobile app as a secondary layer connected to your dog(s)' profile. You may register multiple dogs under a single human account. You may also invite additional secondary humans to your dog(s)' account profiles.
3.2 Account Creation
You must provide accurate, current, and complete information during registration and keep it updated. You may create only one primary human account, but you may invite secondary human account holders to your dog's profile. Secondary humans may not delete a primary account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.3 Dog Profiles
Each dog profile requires a name and a photo to activate. Dog profiles carry public-facing @handles and display breed, age, personality, energy levels, and play style information to other users. You represent and warrant that any dog you register on TailsTrails is a dog you own or for which you are the primary caretaker, and that you have the legal right and authority to make decisions regarding that dog.
3.4 Accuracy of Dog Information
You agree to provide truthful and accurate information about your dog, including but not limited to breed, age, temperament, energy level, training level, behavioral tendencies, and health status, including spay/neuter information. Misrepresenting your dog's characteristics — particularly regarding aggression, reactivity, known behavioral issues, or contagious health issues — is a serious violation of these Terms and may result in immediate account termination.
3.5 Account Security
You are responsible for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access. TailsTrails is not liable for any loss or damage arising from your failure to maintain the security of your account.
4. The Waitlist and Early Access
TailsTrails is currently in a pre-launch waitlist phase. The waitlist website allows you to create an account, complete your dog's profile, earn Treats, discover your Pack Leader archetype, and join the community before the mobile app launches.
During the waitlist phase:
- You may invite friends to the community and your local "Pack" to earn Treats, redeemable for 'real-world' perks and discounts.
- Features, availability, and launch timing are subject to change without notice.
- Waitlist position does not guarantee access to the mobile app at launch or to any specific features. However, completing your dog and human profile, creating an account, and building your "Pack" via accepted invitations, accelerates early access as a "Founding Member".
- Treats earned during the waitlist phase carry over to the full mobile app and may be redeemed post-launch. However, TailsTrails reserves the right to adjust Treats balances, earning rates, and redemption values as part of the transition from waitlist to live app, provided we give at least 30 days' notice of any material changes to the Treats economy.
- Beta or preview features may be offered to select users and may be modified, limited, or discontinued at any time.
We value our early community and intend to reward early participants. However, participation in the waitlist does not create any contractual right to specific features, rewards, or outcomes.
5. The Treats Economy and TrailPass
5.1 Treats
Treats are TailsTrails' points-based reward system. You earn Treats by completing actions on the platform, including dog and human profile completion, referrals, engagement activities, creating or attending events, and other qualifying actions as described in the Service.
When redemption launches with the mobile app, Treats can be redeemed for:
- Access to events and exclusive community experiences
- TailsTrails-branded merchandise and swag
- Discounts and offers from sponsors and partner businesses
- Other rewards as they become available
Treats are subject to the following rules:
- Treats have no cash value and cannot be exchanged for money, cryptocurrency, or any other form of currency.
- Treats cannot be transferred, sold, or traded between accounts.
- Treats balances are personal to your account and are forfeited upon account deletion or termination for cause.
- TailsTrails reserves the right to modify the actions that earn Treats, the amounts awarded, and the redemption options and values, with reasonable notice to users.
- Treats may expire if your account is inactive for 12 consecutive months. We will notify you before any expiration.
- TailsTrails reserves the right to revoke Treats earned through fraud, abuse, or violation of these Terms, without notice.
5.2 TrailPass
TailsTrails may offer TrailPass — a seasonal, tiered progression system (similar to a battle pass) that allows you to unlock virtual and real-world rewards by completing challenges and earning Treats during a defined season.
When available, the TrailPass will operate as follows:
- Each TrailPass season runs for a defined period (e.g., 8–12 weeks).
- You may participate on a limited number of TrailPass challenges on a free tier. The full premium and VIP tracks feature additional rewards and perks.
- Rewards may include virtual items, exclusive badges, physical merchandise, partner discounts, early or guaranteed access to exclusive events, and early access to features.
- Progress and rewards earned during a TrailPass season are final. Unclaimed rewards after the season ends may expire.
- TrailPass purchases are non-refundable once the season has begun, except as required by applicable law.
- TailsTrails reserves the right to modify, suspend, or discontinue the TrailPass at any time.
5.3 No Monetary Value
Neither Treats nor TrailPass rewards constitute property, have monetary value, or create any vested right. They exist solely within the TailsTrails ecosystem. TailsTrails is not a bank, money transmitter, or stored-value provider. Nothing in this section creates any obligation for TailsTrails to maintain, redeem, or compensate you for Treats or TrailPass rewards beyond what is described in the Service at the time of redemption.
6. Pack Leaders
6.1 Role and Qualification
Pack Leaders are community members who have qualified through the TailsTrails Discovery Quest and accepted the Pack Leader role. Pack Leader status is earned, not purchased. TailsTrails reserves the right to modify the qualification criteria and to revoke Pack Leader status at any time for violation of these Terms.
6.2 Pack Leaders Are Not Agents of TailsTrails
Pack Leaders are users of TailsTrails. They are not employees, contractors, agents, or representatives of TailsTrails Social Inc. Nothing in these Terms or in the Pack Leader role creates an employment, agency, partnership, or joint venture relationship between a Pack Leader and TailsTrails.
6.3 Pack Leader Privileges
Pack Leaders may create and manage events, build and organize neighborhood packs, report hazards, map curated routes, and access elevated community features. Pack Leaders may see limited information about members who join their events or packs, as described in the Privacy Policy (Section 7). Pack Leaders may receive complimentary or discounted access to paid features as part of their role; the specific benefits will be communicated directly and may change over time.
6.4 Pack Leader Obligations
By accepting the Pack Leader role, you agree to:
- Use member information only for the purpose of organizing and managing TailsTrails community activities
- Not share, sell, export, scrape, or misuse any member information accessed through your Pack Leader role
- Not contact members outside of TailsTrails using information obtained through the platform, unless the member has independently shared their contact details
- Follow the TailsTrails Community Guidelines at all times
- Comply with all applicable local, state, provincial, and national laws when organizing events, including any permits, insurance, or safety requirements
- Not represent yourself as an employee, agent, or official representative of TailsTrails Social Inc.
- Accurately describe any events you organize, including location, expected activities, and any relevant safety information
6.5 Pack Leader Event Liability
Pack Leaders organize events at their own initiative and responsibility. Events take place on public property or at third-party venues — never on TailsTrails-owned or TailsTrails-operated premises. TailsTrails provides the platform for event coordination but does not organize, supervise, attend, insure, or control Pack Leader events, and has no control over or responsibility for the venues where events take place.
Pack Leaders acknowledge that they bear personal responsibility for events they create and organize, including venue selection, safety assessment, and compliance with any applicable venue rules or local regulations. Pack Leaders agree to the Assumption of Risk and Indemnification provisions in Sections 12 and 19 of these Terms.
TailsTrails strongly recommends that Pack Leaders who organize regular or large-scale events obtain personal liability insurance appropriate to their activities and confirm that their chosen venue permits the planned activity.
6.6 Founding Pack Leaders
Pack Leaders who qualify before the mobile app launches receive Founding Pack Leader status, which includes a permanent Founding badge, bonus Treats, and a VIP Leader Box (a quarterly shipment of curated dog products). The first 100 qualified Pack Leaders in each city additionally receive a one-time 2,000 Treats bonus and a 2x Treats earning multiplier for the 90 days following mobile app launch. Founding status is non-transferable and is contingent on continued compliance with these Terms. TailsTrails reserves the right to modify the VIP Leader Box program with notice.
6.7 Intellectual Property of Proof Artifacts
Any 'Proof Artifacts' (including but not limited to photos, videos, attendance counts, and testimonials) captured and uploaded by Pack Leaders in the course of their duties are the property of TailsTrails Social Inc. and are licensed for use in sales decks, sponsor case studies, and national marketing materials.
7. User Conduct and the No Jerks Policy
TailsTrails is a community built on trust, safety, and genuine connection between dog owners. We maintain a "No Jerks" policy. You agree to use TailsTrails in a manner consistent with its purpose and to treat all members of the community with respect.
7.1 Prohibited Conduct
You agree not to:
- Harass, bully, stalk, intimidate, or threaten any other user
- Post false, misleading, defamatory, or fraudulent content
- Engage in spam, unsolicited commercial messages, or promotional activity outside designated areas
- Create fake profiles, impersonate other people or dogs, or operate multiple human accounts
- Use the platform for any illegal activity or to facilitate any illegal activity
- Scrape, mine, crawl, or use automated tools to extract data from TailsTrails
- Attempt to reverse-engineer, decompile, or interfere with the security or operation of the Service
- Use TailsTrails to facilitate the sale, purchase, breeding, or rehoming of dogs
- Bring a dog to a meetup or event that you know to be aggressive, reactive, dangerous, or contagious without prior disclosure to the event organizer and other attendees
- Misrepresent your dog's temperament, behavioral history, health status, or vaccination records
- Use information obtained through TailsTrails (including Pack Leader data) for commercial purposes outside the platform
- Upload content depicting or promoting animal abuse, neglect, cruelty, or fighting
- Engage in unauthorized commercial solicitation. Users, including those with Pack Leader status, are strictly prohibited from using the Platform or member data to build independent commercial databases or to solicit members for competing pet-care or social services.
7.2 Enforcement
TailsTrails may, at its sole discretion and without prior notice where safety is concerned:
- Issue warnings for minor or first-time violations
- Temporarily suspend accounts pending investigation
- Permanently ban users for serious or repeated violations
- Revoke Pack Leader status independently of account actions
- Forfeit Treats balances earned through or associated with violations
- Remove content that violates these Terms or Community Guidelines
- Report illegal activity to law enforcement
7.3 Reporting
Users can report violations by contacting [email protected] or, when available, through in-app reporting tools. We take all reports seriously and will investigate promptly. Filing a false or malicious report is itself a violation of these Terms.
8. User-Generated Content
8.1 Your Content
You retain ownership of the content you create and post on TailsTrails, including photos, videos, text, and comments ("Your Content").
8.2 License Grant
By posting content on TailsTrails, you grant TailsTrails Social Inc. a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, modify, and create derivative works of Your Content in connection with operating, promoting, and improving the Service. This license exists for the purpose of displaying your posts in the feed, showing your dog's profile to other users, featuring content in promotional materials, and similar Service-related uses.
This license terminates when you delete Your Content or your account, subject to the 30-day deletion process described in the Privacy Policy and reasonable technical delays in removing cached or archived copies.
This license does not grant TailsTrails the right to use Your Content to train artificial intelligence models on identifiable personal data. Any use of content for AI improvement will be limited to anonymized and aggregated data as described in the Privacy Policy.
8.3 Content Standards
Your Content must comply with the Community Guidelines and these Terms. You may not post:
- Content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Content depicting or promoting animal abuse, neglect, cruelty, or fighting
- Content that infringes any third party's intellectual property, privacy, or other rights
- Sexually explicit or adult content
- Content designed to deceive or mislead other users
8.4 Content Moderation
TailsTrails may use a combination of AI-powered tools and human review to moderate content on its social feeds or Pack groups for safety, spam, and compliance with our Community Guidelines. We reserve the right to remove any content at our sole discretion. Content moderation decisions may be appealed through [email protected].
8.5 Third-Party Content and No Endorsement
Content posted by other users does not reflect the views or opinions of TailsTrails. We are not responsible for the accuracy, completeness, safety, or legality of user-generated content. Inclusion of any content on the platform does not constitute endorsement by TailsTrails.
8.6 Photos of Others
If you post photos or videos that include other people, their dogs, or their property, you should have their consent. Any user may request removal of content that features them or their dogs by contacting [email protected].
9. Subscriptions and Payments
9.1 Free and Paid Tiers
TailsTrails offers a free tier with core community features. Paid subscription tiers with additional features will be available for purchase when the mobile app launches. Current pricing, tier details, and included features are displayed within the Service and may change over time.
9.2 Billing and Renewal
Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). By purchasing a subscription, you authorize TailsTrails to charge your selected payment method on a recurring basis until you cancel. Billing is processed through our payment partners: Apple App Store (for iOS in-app purchases) and Google Play Store (for Android in-app purchases).
9.3 Cancellation
You may cancel your subscription at any time through your account Settings or through the app store where you subscribed. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have already paid for. No partial refunds are provided for unused time within a billing period.
9.4 Refunds
Refund policies for App Store and Play Store purchases are governed by Apple's and Google's respective refund policies. If we ever offer purchases directly through the web, we will publish the refund terms for them before doing so. To request a refund, contact [email protected].
9.5 Price Changes
We will provide at least 30 days' notice before increasing subscription prices. Price changes will apply starting with the next billing cycle after the notice period. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
9.6 Taxes
Subscription prices may not include applicable taxes. You are responsible for any taxes, duties, or governmental charges imposed on your subscription payments.
10. Referral Program
TailsTrails offers a referral program that allows you to earn Treats by inviting friends to join. Each user receives a unique referral code or link. When a referred person creates an account and meets the qualifying criteria, both the referrer and the new user earn Treats as described in the Service.
The referral program is subject to these Terms and may be modified, capped, or discontinued at any time. The following are prohibited and may result in Treats revocation and account suspension:
- Self-referrals or creating multiple accounts to earn referral rewards
- Distributing referral links through spam, unsolicited bulk messaging, or deceptive means
- Using bots, scripts, or automated systems to generate referrals
- Any form of referral fraud or manipulation
11. Dog Safety, Verification, and Health Requirements
11.1 Our Commitment to Safety
TailsTrails is committed to creating a safe environment for dogs and their owners. We use AI-powered matchmaking to suggest compatible dogs based on breed, age, temperament, energy level, play style, training level, spay/neuter status, and behavioral traits, as well as human lifestyle preferences. We implement verification and health requirements to promote safety. However, no platform can guarantee the behavior of any dog or person in real-world interactions.
11.2 Identification and Verification
TailsTrails may require identity verification for certain features or roles, including but not limited to:
- Email verification during account creation
- Phone number verification via SMS
- Pack Leader identity verification
When available, the mobile app may implement additional verification measures, including photo-based identity confirmation. TailsTrails reserves the right to expand verification requirements over time to improve community safety.
11.3 Vaccination and Health Records
TailsTrails may require users to confirm or provide documentation of their dog's vaccination status, including but not limited to rabies, distemper, parvovirus, and Bordetella (kennel cough). Specific requirements may vary by jurisdiction and event type.
By submitting vaccination or health information, you represent and warrant that the information is accurate and current. Falsifying vaccination or health records is a serious violation of these Terms and may result in immediate and permanent account termination.
TailsTrails does not independently verify vaccination records unless we implement a veterinary verification partnership, which will be announced separately. Users participate in events and meetups in reliance on the self-reported health information of other users' dogs.
11.4 Behavioral Disclosure
You have a responsibility to accurately represent your dog's behavioral tendencies. TailsTrails strongly recommends — and for certain features may require — that you disclose:
- Known aggression toward other dogs or people
- Reactivity to specific triggers (e.g., other dogs, children, bicycles, loud noises)
- Any history of biting, snapping, or injuring another dog or person
- Any ongoing behavioral training or management requirements (e.g., muzzle requirement)
- Neuter/Spay status
Failure to disclose known behavioral risks that result in harm to another user, dog, or third party may be grounds for immediate account termination and may expose you to personal legal liability independent of these Terms.
11.5 No Guarantee of Safety
Despite our verification requirements, AI matchmaking, and safety features, TailsTrails cannot and does not guarantee the behavior, health, temperament, or vaccination status of any dog on the platform. Profile information, including vaccination and behavioral data, is self-reported by users and is not independently verified by TailsTrails unless explicitly stated. You acknowledge this limitation and accept the associated risks as described in Section 12.
12. Assumption of Risk — Real-World Interactions
12.1 Platform, Not Organizer or Venue
TailsTrails is a technology platform that facilitates connections between dog owners. We are not an event organizer, venue operator, dog trainer, veterinarian, kennel, daycare, dog walking service, or pet care provider. We do not organize, supervise, attend, insure, or control any real-world interactions, events, meetups, or activities that occur between TailsTrails users, whether or not those interactions were facilitated through the Service.
TailsTrails does not own, operate, lease, or control any physical location where events or meetups take place. Pack Leader events and user meetups occur on public property (such as parks, trails, and sidewalks) or at third-party venues (such as cafés, restaurants, and pet-friendly businesses). TailsTrails has no premises liability, no control over venue conditions, and no authority over the rules or policies of any third-party location. Users are responsible for assessing the safety and suitability of any venue before attending.
12.2 Inherent Risks of Dog Interactions
Dogs are living animals with individual temperaments, instincts, and behaviors that can be unpredictable. Interactions between dogs — and between dogs and people — carry inherent risks that cannot be fully eliminated regardless of the precautions taken. These risks include but are not limited to:
- Dog bites, scratches, or attacks
- Injuries from dog play, rough behavior, or startled reactions
- Allergic reactions to dogs or outdoor environments
- Transmission of parasites, illness, or disease between dogs
- Injuries sustained while walking, running, or hiking with dogs
- Property damage caused by dogs
- Theft, loss, or damage to personal property at events or meetups
- Injuries or harm caused by third parties at locations where events take place
- Conditions at public or third-party venues, including terrain, weather, traffic, and other environmental hazards
- Actions or policies of third-party venue operators (cafés, restaurants, businesses) where events are held
12.3 Voluntary Assumption of Risk
BY USING TAILSTRAILS AND PARTICIPATING IN ANY REAL-WORLD INTERACTION, EVENT, MEETUP, WALK, OR ACTIVITY FACILITATED THROUGH THE SERVICE — WHETHER ORGANIZED BY A PACK LEADER, ANOTHER USER, OR YOURSELF — YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING FROM SUCH PARTICIPATION, WHETHER CAUSED BY THE NEGLIGENCE OF TAILSTRAILS, OTHER USERS, PACK LEADERS, OR OTHERWISE.
This assumption of risk applies to all interactions facilitated through TailsTrails, including but not limited to: Pack Leader events, informal meetups arranged through the platform, group walks, dog park visits, and any other real-world contact between users who connected through the Service.
12.4 Your Responsibilities
When participating in real-world interactions facilitated through TailsTrails, you are responsible for:
- Your dog's behavior at all times — you are the handler and custodian
- Accurately representing your dog's temperament, behavioral history, and any known risks
- Complying with all applicable local leash laws, licensing requirements, vaccination mandates, and breed-specific legislation
- Assessing the safety and suitability of any event, location, or interaction before participating
- Carrying adequate insurance for your dog if required or recommended by your jurisdiction
- Supervising your dog and maintaining control at all times during interactions with other dogs and people
- Removing your dog from any situation where it appears stressed, aggressive, or at risk
12.5 No Vetting or Background Checks
TailsTrails does not conduct criminal background checks on users (beyond the eligibility representations in Section 2), does not verify identities beyond the registration and verification processes described in these Terms, and does not independently assess or certify the temperament, training, or safety of any dog on the platform. Pack Leaders are qualified through the Discovery Quest personality assessment, which is a community engagement tool — not a professional evaluation or safety certification.
12.6 AI Matchmaking Is Not a Safety Guarantee
TailsTrails' AI-powered matchmaking system suggests compatible dogs and activities based on self-reported profile data, location, and behavioral traits. These recommendations are algorithmic suggestions designed to improve the likelihood of positive interactions. They are not safety certifications, behavioral assessments, or guarantees of compatibility. A match recommendation from TailsTrails does not mean that an interaction will be safe, enjoyable, or incident-free.
13. Location Services and the Interactive Map
TailsTrails uses location data to connect you with dogs and dog owners in your neighborhood. How we collect and use location data is described in our Privacy Policy.
13.1 Waitlist (Current)
During the waitlist phase, location is determined by the Zip you provide during signup and optional IP-based geolocation.
13.2 Mobile App Map (When Available)
The mobile app will include an interactive map with features that may include real-time location sharing, nearby dog discovery, and event locations. Use of GPS location data requires your explicit device permission and can be revoked at any time through your device settings.
13.3 Ghost Mode and Privacy Controls (When Available)
Ghost Mode allows you to use TailsTrails without being visible to other users on the map. TailsTrails automatically creates a privacy zone around your home address to blur your precise location.
13.3.1 Safety Responsibility in Ghost Mode
The use of Ghost Mode (incognito walking) does not waive a user's responsibility to adhere to the No Jerks Policy or local leash laws. Users in Ghost Mode remain liable for any physical interactions or incidents involving their dog, regardless of their visibility status on the interactive map.
13.4 Location Accuracy
Location data is provided for community-matching purposes and may not be perfectly accurate. TailsTrails is not responsible for inaccuracies in location data, including but not limited to errors in GPS positioning, IP geolocation estimates, or user-provided Zips.
14. Artificial Intelligence and Matchmaking
TailsTrails uses artificial intelligence and machine learning to power matchmaking (our PackSense™ system), content personalization, Pack Leader archetype discovery, commercial content relevance, and safety moderation. Full details of our AI use are in the Privacy Policy (Section 5).
14.1 Matchmaking Recommendations
AI-powered match recommendations are algorithmic suggestions based on self-reported profile data. They are not guarantees of compatibility, safety, or any particular outcome. You are responsible for exercising your own judgment in deciding whether to interact with any other user or dog.
14.2 Pack Leader Archetypes
The Pack Leader archetype assigned through the Discovery Quest is based on a weighted scoring algorithm applied to your quiz responses. It reflects our assessment of your community leadership style. It is not a psychological evaluation, professional assessment, medical diagnosis, or certification of any kind.
14.3 Opting Out
You may opt out of AI-powered matchmaking and AI-based commercial content targeting through your account Settings. Opting out of matchmaking will limit your ability to receive personalized recommendations. See the Privacy Policy (Sections 5.2 and 6.4) for full details on your AI and advertising choices.
15. Advertising, Sponsored Content, and Marketplace
15.1 Sponsored Content
TailsTrails may display sponsored content, including sponsored events, local business promotions, and product recommendations. Sponsored content will be clearly identified as such. TailsTrails does not endorse any product, service, or business featured in sponsored content.
15.2 Marketplace (When Available)
TailsTrails may offer a local marketplace for dog-related products, services, and events. Marketplace transactions are between you and the seller. TailsTrails is not a party to marketplace transactions and does not guarantee the quality, safety, legality, or authenticity of any item or service listed. Any dispute arising from a marketplace transaction must be resolved directly between the buyer and seller.
15.3 Third-Party Ad Networks
TailsTrails may use third-party advertising networks as described in the Privacy Policy (Section 6.2). Your advertising choices, including opt-out of personalized targeting, are described in the Privacy Policy (Section 6.4).
16. Intellectual Property
16.1 TailsTrails' Intellectual Property
The TailsTrails name, logo, brand identity, visual design, software, algorithms, the PackSense matchmaking system, the Treats economy, the TrailPass system, Pack Leader archetypes, Discovery Quest, and all related intellectual property are owned by or exclusively licensed to TailsTrails Social Inc. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works based on any part of the Service without our prior written consent.
16.2 Your Intellectual Property
You retain ownership of Your Content, subject to the license grant in Section 8.2.
16.3 Feedback
If you provide feedback, suggestions, ideas, or recommendations regarding TailsTrails ("Feedback"), you grant TailsTrails a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation or compensation to you. You are not required to provide Feedback.
16.4 Copyright Complaints (DMCA)
If you believe that content on TailsTrails infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (or equivalent legislation in your jurisdiction) to our designated agent at [email protected]. Your notice must include identification of the copyrighted work, identification of the infringing content and its location on the Service, your contact information, a statement of good faith belief, and a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.
17. Third-Party Services and Links
TailsTrails integrates with and may link to third-party services, including payment processors (Apple, Google), analytics providers, AI services, advertising networks, and content management systems. Your use of these third-party services is subject to their own terms and privacy policies. TailsTrails is not responsible for the content, functionality, security, or practices of any third-party service.
Links to third-party websites or services do not constitute endorsement by TailsTrails.
18. Disclaimers and Limitation of Liability
18.1 "As Is" and "As Available"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAILSTRAILS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, TailsTrails does not warrant that:
- The Service will be uninterrupted, error-free, secure, or available at any particular time
- The results or information obtained through the Service will be accurate, reliable, or complete
- Any defects or errors in the Service will be corrected
- The Service will meet your expectations or requirements
- Any dog or user on the platform is safe, trustworthy, or accurately represented
18.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAILSTRAILS SOCIAL INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, PERSONAL INJURY, PROPERTY DAMAGE, OR PET INJURY, ARISING FROM OR RELATED TO:
- Your use of or inability to use the Service
- Any real-world interaction, event, meetup, or activity facilitated through the Service
- The conduct, behavior, or actions of any other user, dog, or Pack Leader
- Any content posted by other users
- Unauthorized access to or alteration of your data
- Any AI-generated recommendation, match, or suggestion
- Any third-party product or service accessed through the Service
18.3 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAILSTRAILS SOCIAL INC.'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO TAILSTRAILS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
18.4 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or the exclusion or limitation of liability for consequential or incidental damages. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our gross negligence or willful misconduct.
19. Indemnification
You agree to indemnify, defend, and hold harmless TailsTrails Social Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms, the Privacy Policy, or the Community Guidelines
- Your dog's behavior, including any injury, damage, or harm caused by your dog to another person, dog, or property
- Any event you organize in your capacity as a Pack Leader
- Your violation of any applicable law, regulation, or third-party right
- Any content you post on the Service
- Any dispute between you and another user
- Any misrepresentation of your dog's temperament, health, vaccination status, or behavioral history
20. Dispute Resolution
20.1 Informal Resolution
Before initiating any formal dispute proceeding, you agree to first contact TailsTrails at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved through direct communication, and we encourage you to reach out before taking formal action.
20.2 Binding Arbitration
If we cannot resolve a dispute informally within 30 days, you and TailsTrails agree to resolve the dispute through final and binding individual arbitration, rather than in court. Arbitration will be administered by ADR Chambers (or, if ADR Chambers is unavailable, a mutually agreed alternative arbitration provider) under its applicable rules. Arbitration will be conducted in English, and may be conducted in person in Vancouver, British Columbia, or remotely by videoconference at the election of either party.
The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
20.3 Class Action and Jury Trial Waiver
YOU AND TAILSTRAILS AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND TAILSTRAILS WAIVE ANY RIGHT TO A JURY TRIAL.
If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute will proceed in court.
20.4 Exceptions
Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
20.5 Opt-Out
You may opt out of the arbitration and class action waiver provisions by sending written notice to [email protected] within thirty (30) days of creating your TailsTrails account. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts described in Section 21.
20.6 EU, UK, and Consumer Protection Carve-Out
If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws that cannot be waived by contract, the arbitration and class action waiver provisions in this section do not apply to you to the extent they conflict with your mandatory consumer rights. In such cases, disputes will be resolved in accordance with applicable consumer protection laws and in the courts available to you under those laws.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to the arbitration provisions in Section 20, any disputes not resolved through arbitration shall be submitted to the exclusive jurisdiction of the courts of British Columbia, Canada.
Nothing in these Terms affects your statutory rights as a consumer under the mandatory laws of your jurisdiction that cannot be waived by contract. If you are a consumer in the EU, UK, Australia, or another jurisdiction with mandatory consumer protection laws, those laws apply to the extent they provide greater protection than these Terms.
22. Termination

24. Miscellaneous
24.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
24.2 Waiver
The failure of TailsTrails to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time.
24.3 Assignment
TailsTrails may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
